Trans-Nzoia Governor Faces Conflict of Interest Charges in High-Stakes Court Battle


Trans-Nzoia Governor George Natembeya has been formally charged with the unlawful acquisition of public funds amounting to Ksh 3,252,568, amid damning allegations of conflict of interest involving companies trading with his administration.


According to the Director of Public Prosecutions (DPP), the funds were unlawfully obtained through payments by the county government to Lyma Agro Science Limited, Maira Stores, and Easterly Winds Limited between January 1, 2023 and April 30, 2025—transactions in which Governor Natembeya is alleged to have held an indirect financial interest.


The embattled governor was arraigned before Principal Magistrate Charles Ondieki, where he pleaded not guilty to the charges, including two counts of conflict of interest contrary to Section 42(3) as read with Section 48 of the Anti-Corruption and Economic Crimes Act, 2003.


Court documents revealed that Natembeya allegedly received Ksh 1,127,900 through Mercy Chelangat, the director of Lyma Agro Science and owner of Maira Stores. He is further accused of indirectly benefiting from Ksh 2,124,668 through Emmanuel Wafula Masungo, the beneficial owner of Easterly Winds Limited.


The court released Natembeya on a Ksh 1Million bond or an alternative cash bail of Ksh 500,000, but imposed strict conditions:


  • He is barred from accessing his office for 60 days.
  • He cannot leave the country without express court permission.
  • He must refrain from contacting witnesses or discussing the matter in any public or media forum.



The case is being prosecuted by senior state officers including Assistant Director of Public Prosecutions Mr. Eliphas Ombati, Mr. Alex Akula, Principal Prosecution Counsel Mr. Victor Owiti, and Prosecution Counsel Mr. Abdisalam Bore.


The prosecution team has been ordered to supply all documentary evidence by June 3, 2025, when the matter returns to court for pre-trial directions.


This case now casts a long shadow over the governor’s leadership, raising critical questions about transparency and accountability in county governments across Kenya.
